Travel Terms & Conditions: Manthos Expeditions

Manthos Expeditions is the creator and publisher of the website and is responsible for its development and maintenance.

Article 1 - Definitions
  • Organizer: Manthos Expeditions.

  • Traveler: Any person wishing to conclude an agreement with the Organizer regarding a Trip.

  • Travel Service: Services included in the trip, such as passenger transport, horse/animal rental, equipment, accommodation, and excursions.

  • Travel Service Provider: The service provider performing a part of the Trip (e.g., local stables, mountain guides, riads).

  • Agreement: The agreement relating to the booked Trip, including these Terms.

  • In Writing: In writing or by electronic means, including email.

  • Terms: These general terms and conditions of Manthos Expeditions.

  • Working Days: Monday to Friday (9:00 AM – 5:00 PM CET), excluding Dutch public holidays.

Article 2 - Applicability

2.1 Scope

These Terms apply to all Trips offered or agreed upon by Manthos Expeditions. Deviating terms must be agreed upon In Writing.

 

THE BOOKING & INFORMATION
Article 3 - Formation of the Agreement

3.1 Content and Acceptance

The Agreement is formed once the Traveler accepts the offer and the down payment is received. The offer includes only services explicitly described in the quote. Obvious errors do not bind the Organizer.
 

3.2 Minor Travelers

The Traveler booking the trip must be at least 18 years of age.

Article 4 - Information & Mandatory Insurance

4.1 Travel Documents

The Traveler is responsible for possessing a valid passport, necessary visas, and health certificates required for entry into Morocco.
 

4.2 Mandatory Insurance Requirement

Because Manthos Expeditions operates in remote and rugged terrain involving animals, comprehensive travel insurance including specific coverage for horse riding, combat sports, trekking, mountain climbing, medical evacuation, and repatriation is mandatory. Proof of insurance must be provided upon request. Failure to secure this may result in exclusion from the Trip without a refund.

Article 5 - Information by the Traveler

5.1 Relevant Health & Mobility Information

The Traveler must provide all relevant information regarding the health or physical condition of all registered participants. This includes any condition that could affect safety while horse riding or grappling. If information is withheld, Manthos Expeditions reserves the right to exclude the Traveler from participation without a refund.

 

PAYMENTS AND CANCELLATIONS
Article 6 - Payment

6.1 Final Payment

The balance of the travel sum must be paid no later than 3 months before departure. For bookings within 3 months of departure, the full amount is due immediately
 

Article 7 - Substitution (Transfer of Booking)

7.1 Conditions for Transfer

A Traveler may transfer their spot to another person up to 7 days before departure. The new person must meet all conditions of the trip (including BJJ skill level if required and physical fitness for riding). Both the original Traveler and the new participant are jointly liable for the travel sum and any administrative/transfer fees.
 

Article 8 - Changes by the Traveler

8.1 Requests for Change The Traveler may request changes to the booking. Manthos Expeditions is not obliged to accept. If accepted, any additional costs from service providers plus a reasonable administrative fee will be charged to the Traveler.​
 

Article 9 - Cancellation by the Traveler

9.1 Cancellation Fees

The following fees apply upon cancellation:

  • Until 3 months before departure: The down payment or 50% of the travel sum.

  • 3 months to 14 days before departure: 75% of the travel sum.

  • From 14 days before departure: 100% of the travel sum.

Article 10 - Minor Changes by the Organizer

10.1 Right to Change

Manthos Expeditions may make minor changes to the travel program (e.g., swapping the order of riads or changing the specific trail route) for operational reasons. The Traveler does not have to be informed on these changes. If there are any major changes, Travellers will be informed in writing.
 

Article 11 - Cancellation by the Organizer

11.1 Minimum Participants

Manthos Expeditions may cancel the trip if the minimum number of participants (8 participants) is not reached. This must be communicated at least 20 days before departure for trips longer than 6 days.
 

11.2 Force Majeure

The Organizer may cancel the trip due to unavoidable and extraordinary circumstances (e.g., war, natural disasters, or sudden border closures). In such cases, the Traveler receives a full refund of the travel sum but is not entitled to further compensation for secondary costs (like flights purchased separately).

 

Article 12 - Responsibility & Performance

12.1 Execution of the Trip

The Organizer is not responsible for the performance of the travel services included in the Agreement, regardless of whether these services are performed by Manthos Expeditions or local Moroccan partners.

12.2 Duty to Assist

Manthos Expeditions will provide appropriate assistance without delay to a Traveler in difficulty, specifically by providing information on health services, local authorities, and consular assistance.

MOROCCO EXPEDITION & ACTIVITY PROVISIONS
Article 13 - Expedition Activities & Risk Acknowledgement

13.1 Animal & Equipment Use

Manthos Expeditions facilitates the use of animals (e.g., horses, mules) and specialized gear through local Moroccan providers. By booking, the Traveler acknowledges:

  • Local Standards: Animals and equipment are provided in a condition customary for Morocco. While selected for reliability, they may behave unpredictably due to nature or terrain.

  • Acceptance of Risk: Riding or trekking in the Atlas Mountains or desert regions carries inherent physical risks. Falls, animal behavior, and rough terrain are considered part of the "expedition adventure." The Traveler assumes full responsibility for their conduct and safety while interacting with animals.
     

13.2 Insurance & Limited Coverage

Local providers may have limited liability insurance. Injury to the Traveler or damage caused by the Traveler to the animals or gear is generally not covered by local providers. The Traveler remains personally liable for these risks.
 

13.3 Damage to Equipment & Livestock

Damage to or loss of provided gear (saddles, tack, camping equipment) caused by the Traveler's negligence or improper use is for the account of the Traveler.
 

13.4 Security Deposit

A security deposit of EUR 400 must be paid in advance. Manthos Expeditions is authorized to deduct costs for damaged/lost equipment or local claims from this deposit. If costs exceed EUR 400, the Organizer is authorized to collect the full balance from the Traveler.

 

LIABILITY & COMPLAINTS
Article 14 - Liability

14.1 Limitation of Liability

The Organizer is not liable for damage or injury resulting from circumstances attributable to the Traveler, unforeseen animal behavior, or Force Majeure. Liability is limited to three times the travel sum, except for personal injury caused by the Organizer's gross negligence.

Article 15 - Complaints

15.1 Reporting on-site

Complaints must be reported immediately to the local guides and the Organizer (via WhatsApp/email) to allow for a resolution during the trip.

 

Article 16 - Final Provisions

16.1 Applicable Law

The Agreement is exclusively governed by Dutch Law.
 

16.2 Competent Court

The court in the Organizer’s place of business (Netherlands) has exclusive jurisdiction over disputes.
